PRIVACY POLICY
This Privacy Notice is issued in compliance with the requirements of the Personal Data Protection Act 2010 (“PDPA”) and its regulations to inform you of your rights with regards to your Personal Data (as defined within the Act), that we, Promptpay Solution Sdn. Bhd including our holding companies, subsidiaries and associated companies (herein referred to as “Promptpay Solution”, “we”, “our” or “us”) maintain as part of our records.1. Purpose of Information Collected
We will collect information about you when you interact actively with us, be it directly or indirectly, for example when you contact us for further information, conducting payment transactions, or take part in any of our online activities.
The use of this information is for the following primary purposes:
- Enter into relevant sale and purchase agreement;
- Communication of services, sale, and purchase transactions;
- Payment transaction processing;
- Settlement of funds, Refund or Cancellation, Dispute and/or Chargeback of the payment transaction;
- Recurring payment service and/or tokenization;
- General administration;
- Manage and maintain your account(s) and facility(ies) with us;
- Respond to your enquiries and complaints and generally resolve disputes;
- Update, consolidate and improve the accuracy of our records;
- Produce data, reports, and statistics which have been aggregated in a manner that does not identify you as an individual;
- Conduct research and survey, solely for analytical purposes including but not limited to data mining and analysis of your transactions with us;
- Meet the disclosure requirements of any law binding on us;
- For audit, compliance, and risk management purposes;
- For the performance of credit checks;
- Any other purpose that we deem necessary and/or as required or permitted by any law, regulations, guidelines, and/or relevant regulatory authorities.
2. Type of Information Collected
Personal data that we may collect:
- Name, Age, Race, Gender, Nationality, IC Number, Passport Number, Date of Birth;
- Contact Details such as House Number, Mobile Number; Email; Home Town Address; Correspondence Address; Delivery Address; Region or State of staying;
- Credit Card details;
- Bank Account number;
- Any other information supplied by you that can indirectly or directly identify you, in order for us to carry out our contract with you.
3. Disclosure
Your personal data will be kept confidential but you consent and authorise us to provide or share your Personal data, where necessary, to the following class of users:
- Persons/Organisations required under law or in response to government requests;
- Related, subsidiaries, holdings of Promptpay Solution, including future entities under Promptpay Solution;
- Government agencies, statutory authorities, enforcement agencies, and/or credit reporting agencies under law;
- Auditors, accountants, and lawyers under Promptpay Solution;
- Banks, financial institutions, card associations;
- Contractors, sub-contractors, affiliates, and business partners of Promptpay Solution;
- Third-party service /product providers that are deemed necessary or appropriate for the purposes stated above (including those located out of Malaysia, under conditions of confidentiality and similar levels of security);
- Persons under a duty of confidentiality to the Promptpay Solution;
- Any other purpose that we deem necessary and/or as required or permitted by any law, regulations, guidelines, and/or relevant regulatory authorities.
4. Your rights
It is your sole discretion to share your Personal Data and you are solely responsible for the accuracy of the Personal Data provided, whereby we assume that the Personal Data provided are accurate and up to date unless informed otherwise by you. However, should you decline to provide any Personal Data that is essential to us to enable us to process your application/request (for example for the registration), we may not be able to process your application/request or provide you with our products and/or services, we may not be able to communicate notices, value-added services and updates to you and it may affect our capacity to accomplish the above stated purposes.
You reserve the right to access your personal data and request for correction of the Personal Data that might be inaccurate, obsolete, incomplete, or misleading. You are also entitled to limit our processing of your Personal Data.
In that respect you may request to update, access, or limit the processing of your Personal Data in our records by sending your request in writing, together with your name and Account number to support@promptpaysolution.com.my with the e-mail subject “Update Personal Information” pursuant to Paragraph 9 below.
We reserve the right to decline requests that jeopardize the security and privacy of the Personal Data of others as well as requests that are impractical or not made in good faith. Additionally, it is important to note that system-recorded Personal Data is not editable. When we delete any information, it will be deleted from the active database but may remain in our archives. To the extent permitted by law, we may also retain your information for fraud prevention or similar purposes required by laws.
In accordance with the PDPA, and to the extent not limited by any other applicable law, we may:
- Charge an administration fee for processing your request for access or correction to the Personal Data, in compliance with the fees stated in PDPA sub-regulation; and
- Refuse to comply with your request for access or correction to the Personal Data and give you a written reason for such an action.
5. Direct Marketing
Where you have given us consent for marketing, we may use your Personal Data to provide you with information about our and third-party services and/or products, which may be related to your interests, unless requested otherwise by you.We may, in some circumstances, disclose your Personal Data to preferred merchants and strategic partners. Such disclosure will only occur where you have subscribed for particular products and/or services that require such disclosure, and/or where your consent has been obtained, subject at all times to any laws (including regulations, guidelines, and/or obligations) applicable to Promptpay Solution Sdn. Bhd.We take reasonable steps to ensure that the third parties we are sharing your Personal Data with also have appropriate privacy and confidentiality obligations.In addition, you would have been deemed to have given your consent for our continued communication for further information on our products, services, promotions, and matters relating to the primary purposes below, which we may consider to be interesting to you from time to time.6. Protection to Personal Information
Data Security
We shall take the necessary steps to store and process your Personal Data securely. Reasonable security measures have been implemented to prevent the loss, misuse, or unauthorized access of data. We limit access to your Personal Data on a need-to-know basis. Nevertheless, please understand that the transmission of information via the Internet is not completely secure. Although we will do our best to protect your Personal Data, we cannot guarantee the security of your data transmitted through any online means, therefore, any transmission remains at your own risk.We undertake the following security steps:- Implementation of a formal information security policy and necessary technology controls such as firewall, password controls, physical security, logging, and monitoring, etc;
- Process controls such as segregation of duties, defined roles, and responsibilities, and need-to-know basis for staff; and
- Third-party providers and contractors storing or processing personal data have implemented similar acceptable standards of security.
7. Revisions to Privacy Notice
We may review and update this Privacy Notice from time to time to reflect changes in the laws, in our business practices, procedures and structure, and the community’s changing privacy expectations. The latest version of the Privacy Notice will be made available on this platform or via any other mode we view as suitable.If you do not agree to the changes in our use of your Personal Data, you must notify us immediately and/or deactivate your account or cease the products and/or services with us. Continued use of our products and/or services, following notice of such changes shall indicate your acknowledgment of such changes and agreement to be bound by the terms and conditions of such changes.8. Transfer of Your Personal Data Outside Malaysia
It may be necessary for us to transfer your Personal Data outside Malaysia if any of our service providers or strategic partners who are involved in providing part of our services are located in countries outside Malaysia. You consent to us transferring your Personal Data outside Malaysia in the instances whereby it is necessary to fulfill the execution of the products and/or services that you signed up for.We shall take necessary steps to ensure that any such partners are contractually bound not to use your Personal Data for any reason other than to provide the products and/or services they are contracted by us and that they possess and maintain a comparable level of security, to safeguard your personal information.9.
